Non-residents aspiring to work in Singapore require a work visa before they can legally begin employment. Companies that hire non-residents without a valid work permit will be prosecuted under the Employment of Foreign Manpower Act.

The Work Permit (WP) is issued to basic-skilled workers who want to work in Singapore’s in-demand sectors and are from approved source countries. The duration of a WP is two years, subject to the validity of the worker’s passport, the Banker’s/Insurance Guarantee, and the worker’s employment period, whichever is shorter. The worker is only allowed to work for an employer and in the specified occupation. The qualifying salary must be S$2,000 or less.

The Employment Pass (EP) is the main kind of Singapore Work Visa meant for entrepreneurs, executives and skilled professionals who wish to work in Singapore. The term Employment Pass is commonly known as EP, E pass or Employment Visa in Singapore and is used interchangeably in this page. The Ministry of Manpower (MOM) allows foreign professionals to apply for a Singapore Employment Pass after they have incorporated their Singapore Company to enable them to live and work in Singapore. There is no official limit or quota for the Singapore Employment Pass.

Oftentimes, relevant work experience also plays a significant role in determining your eligibility. Employment Pass is the preferred choice for most foreigners who want to set up a company in Singapore and work and live in Singapore for a minimum period of 12 months.

Employment Pass Eligibility Requirements:

The Ministry of Manpower determines your eligibility based on the factors listed below. To be considered for an Employment Pass, you must have a fixed monthly salary of at least S$3,300 (From 1 January 2017, the qualifying salary for Employment Pass (EP) applications will be raised from $3,300 to $3,600) and possess one or more of the following:

  • Acceptable educational qualifications, e.g.a diploma or degree
  • Professional qualifications
  • Specialist skills
  • Related work experience

In some instances, an applicant who does not possess recognized educational qualifications may not necessarily be rejected for an EP, if there are other compensating positive factors in favour of his application, namely:

  • Applicant job profile, salary, citizenship, etc.
  • Repute of the company, employer’s track record, Company paid up capital, tax contribution, etc.
  • Strategic and in-demand skills set; Government highlighted key industry for development, etc.

Below are the procedures for Employment Pass application:

  • To provide Singapore Incorporation for the following required documents must be submitted to Singapore’s Ministry of Manpower (MOM) ○ the passport and Singapore work pass/ student pass/ any other pass (if any) ○ 2 highest education certificates ○ working testimonial (if any) and a resume/ CV ○ completed application form with details of applicant * For married candidates, please provide item 1, 2 & 3 of your spouse.
  • The processing time is 1 week usually. (Manual application will take 5 weeks for processing, therefore, it is advisable to submit online by 3E Accounting always)(From 1 Jun 2015, MOM will no longer accept hardcopy application forms for the Employment Pass application)
  • If the application does not approve in the first assessment, MOM will require additional information (e.g. business plan, testimonial, Employment letter / contract and etc) and we will submit an appeal on your behalf at no additional cost. The appeal process will take 5 weeks usually.
  • Upon approval, you can visit Singapore to collect your work pass within 6 months from the date of approval.
  • In summary, the application could be completed in 1 week to 3 months time.

You are not required to stay in Singapore while applying for the work pass.

EMPLOYMENT PASS TYPES:

ELIGIBILITY REQUIREMENTS

  • Fixed monthly salary: at least S$8,000 Possess acceptable qualifications
  • Fixed monthly salary: at least S$4,500 Possess acceptable qualifications
  • Fixed monthly salary: at least S$3,000 for young graduates from good institutions. Older applicants have to command higher salaries commensurate with the work experience and quality they are expected to bring.

EP SUBMISSION TIMELINE:

Margin Wheeler submits all Employment Pass (EP) applications electronically to the Ministry of Manpower (MOM) so that you can learn of your application outcome sooner.

  • It takes MOM between 1-15 working days to process the application.
  • Upon receiving the In-principle Approval notification, we will make arrangements for the collection of your EP.

The application for the employment pass can only be done once the company has been incorporated. It is not necessary to be physically present in Singapore while the application is being processed

APPROVAL AND COLLECTION OF EMPLOYMENT PASS:

Once the application is approved, the Ministry of Manpower will issue an In-Principle Approval (IPA) letter via email. The IPA letter must be produced upon collection of the EP at the Work Pass Division at the Ministry of Manpower. An IPA letter is valid for six months from the date of notification of approval. To collect your EP you will be required to present:

  • A copy of the IPA letter
  • Recently taken passport size photograph
  • Original passport with the entry embarkation cards
  • Medical exam report* (if the In-Principle Approval states that you require one)
  • Any other documents that are requested in the approval letter

* You may get a medical examination done in your own country through an established clinic/hospital or in Singapore. Most clinics in Singapore provide medical examinations and reports within a day.

ENTRY VISA INTO SINGAPORE:

If you are overseas and require an entry visa to Singapore, your IPA letter will include a single journey entry visa. Upon your arrival in Singapore, we will make an appointment with the Ministry of Manpower on your behalf for fingerprinting. Upon completing the procedures, your pass will be ready in 4 working days. You may collect the pass at the Ministry of Manpower personally or authorize Margin Wheeler to collect it on your behalf.

VALIDITY OF EMPLOYMENT PASS UPON APPROVAL:

The validity of an EP varies and is as follows:

  • First-time applicants – up to 2 years
  • EP renewals – up to 3 years

SINGAPORE EMPLOYMENT PASS REJECTION:

In the event that your Employment pass application is rejected by the authority, our specialists will establish a firm appeal in defence of your position. Singapore Incorporation will investigate why your application has been rejected. Based on the reasons provided by MOM, we will submit an appeal that will address the issues outlined by MOM and also include additional documents as per their request, if any. Please note that it may take three weeks or more to process an appeal, depending on the complexity of the case. Our fees include one free appeal in the event your initial application is unsuccessful.

CHANGE OF EMPLOYER:

Employment Pass holders must apply for a new pass whenever they change employers. There is no need to cancel the existing pass prior to application for a new pass. The Ministry of Manpower evaluates each application for a new pass based on the applicant’s qualifications, work experience, and employer credentials. A new pass will be issued once the old pass is cancelled.

RENEWAL OF EMPLOYMENT PASS:

The Ministry of Manpower will mail an Employment Pass Renewal Form to your employer’s address two months before your EP expires. You should submit the renewal application at least four weeks prior to the expiration of your EP. Once approved, your employer will receive a letter of notification and the new pass is ready for pick up at the Ministry of Manpower.

IMPORTANT NOTE FOR RENEWALS OF EMPLOYMENT VISA:

  • For existing EP holders whose passes expired on or after 1 January 2012, and are affected by these changes, MOM will grant a one-off renewal of up to 2 years per the earlier framework.
  • Pass holders who have applied/who apply for renewal before/after 1 January 2012 are treated equally and given the same one-off renewal. Subsequent renewal applications will be assessed based on the prevailing work pass criteria.
PERSONAL EMPLOYMENT PASS (PEP)

The Personalised Employment Pass (PEP) visa was introduced to provide job flexibility for middle and senior foreign executives working in Singapore. Holders of this Personalised Employment Pass are entitled to stay in Singapore for up to 6 months in between jobs while seeking for new employment opportunities.In addition, foreign executives with years of working experience are entitled to apply for this visa without first securing a job in Singapore.

This Personalised Employment Pass visa is awarded based on the individual applicants merits. The Personalised Employment Pass (PEP) visa is equivalent to a P1 Employment Pass category but with the following benefits:

  • The Personalised Employment Pass is valid for up to 3 years where the holders of this pass are not tied to any single one employer
  • The Personalised Employment Pass holder does not have to cancel and re-apply for a new visa each time he/she changes a new job
  • The Personalised Employment Pass holder can take on employment in any sector or industry
  • Holders of this Personalised Employment Pass are permitted to stay in Singapore for a period of six months even without a job so as to allow them to evaluate employment or work opportunities.

The Personalised Employment Pass is also considered a self-sponsored work visa as one does not require a Singapore company sponsor to apply for this visa. Therefore, this Personalised Employment Pass serves as an ideal work visa for those who have not obtained a job offer in Singapore and are willing to find suitable employment in Singapore.

ELIGIBILITY:

  • Foreign executives currently working overseas with last drawn monthly income of at least S$18,000
  • Current P1 Employment Pass holders with a fixed monthly income of S$12,000

Below are the procedures for Personalised Employment Pass (PEP) application:

  • Application form to be completed by applicants to indicate personal particulars and previous work experience and provide the following information ○ Clear scanned copy of highest education certificates ○ Clear scanned copy of passport’s particulars page ○ Clear scanned copy of salary slips for the latest 3 months ○ Clear scanned copy of latest employment contracts/letters
  • Submit the application to MOM and the Processing Time is 5 weeks.
  • Upon approval, An In-Principle Approval letter will be mailed to the applicant’s Singapore address
  • You can visit Singapore for the collection of the work pass

Kindly take that you are not allowed to set up your own company and hire yourself to work in Singapore. You are expected to work for a Company which you are not a shareholder of the Company

SKILL PASS (S PASS)

Singapore Incorporation, a licensed MOM employment agency, offers Singapore S Pass application services to render further assistance to employers intending to apply an S Pass for their foreign staff, especially companies which are newly registered in Singapore.

The S Pass is a Singapore work visa type designed for mid-level skilled foreign workers employed by companies operating in Singapore. The application is assessed based on a point system with consideration for each of the following factors: salary, education qualifications, skills, job type and work experience. The number of S Pass holders a Singapore company can employ is capped at a sub-quota of 25% of the company’s total workforce.

Validity: It has a validity of 1 or 2 years and is renewable as long as the pass holder remains employed in the company, subject to the prevailing conditions imposed by the authority at the time of renewal.

Benefits: S Pass applicants whose fixed monthly salary is at least S$2,800 may apply for Dependant’s Pass and/or Long-Term Visit Pass for their family members.

Permanent Residence Eligibility: S pass holders are eligible to apply for Singapore Permanent Residency. There is no waiting period but it is advisable to wait for at least three years before applying for Permanent Residence.

ELIGIBILITY:

  • Fixed monthly salary of S$2,000 or above.
  • Possession of a degree, diploma, or technical/specialist qualifications.
  • Relevant work experience and skills.

ENTREPASS

Singapore Incorporation, a licensed MOM employment agency, offers Singapore EntrePass application services to render further assistance to entrepreneurs who are ready to incorporate a new private limited company in Singapore.

The EntrePass (also known as the Entrepreneur Pass) is designed primarily for technopreneurs as well as R&D-intensive enterprises that can inject innovation and vibrancy in Singapore.

If you are a foreign entrepreneur who lacks the appropriate educational qualification or do not qualify under the Employment Pass scheme, but has a proven track record of successful entrepreneurial experience and innovative ideas from overseas which could add to the entrepreneurial vibrancy in Singapore. The application process for EntrePass is more complex than that for the Employment Pass. In addition, it requires a minimum paid-up capital amount of S$50,000.

Renewal of EntrePass:

You must meet all the following criteria to renew your EntrePass on an annual basis . Entrepass is suitable for those who have low qualifications and intended to start his/her own business in Singapore.

  • Company must employ at least two (four from second year forward) full-time local employees;
  • Company must demonstrate total local business spending (TBS) of $100,000 ($150,000 from second year forward) over the past 12 months;
  • Latest audited accounts;
  • Central Provident Fund statements for the employees;
  • Highest educational certificates of employees;
  • Tenancy agreements;
  • Company registration information from the Accounting and Corporate Regulatory Authority;
  • Corporate bank statements for the past three months;
  • Referral letters from customers; and
  • Recent invoices issued/contracts awarded.

Key Considering Factors:

  • Does the applicant have a viable business plan?
  • Is the applicant willing to spend S$100,000 for the first 12 months of the business?
  • Is the applicant willing to hire 2 local Singaporeans within the first 12 months?
  • The applicant must meet at least one of the following requirements either: ○ Receive funding from a recognized third-party venture capitalist or business angel; or ○ Hold a proprietary or licensed Intellectual Property (IP) recognised by an approved national IP institution; or ○ Have research collaboration with a research institution recognised by Agency for Science, Technology and Research (A*STAR), or any local tertiary institution; or ○ Is an incubatee at a recognised incubator supported by SPRING Singapore or National Research Foundation (NRF); or ○ Receive support from a Singapore Government agency.

Documents Required after Approval of the EntrePass

Subsequently, within the first six months of successfully receiving the EntrePass the applicant must submit all of the following:

  • Tenancy contract; and
  • Employees’ CPF statements; and
  • Statement of shareholding structure in the registered company and the date of incorporation.

Company Setup Requirements

  • Minimum: one shareholder plus one resident director plus one company secretary
  • A local registered office address
  • Must register a private limited company with a minimum paid-up capital amount of S$50,000
  • Own between 30 percent and 100 percent of the company shares

EntrePass Visa Eligibility Requirements

  • Submit a ten-page business plan detailing business goals and objectives
  • Have relevant experience and a track record in operating businesses or a unique business proposition

Below are the procedures for Entrepass application:

  • Submission of the Entrepass pass form to us.
  • We will collect the upfront fee for the Entrepass application is S$2,000.
  • Upon receipt of the payment, Business plan will be prepared within 1 to 2 weeks based on the information provided by you.
  • Required application documents will be readily conducted and will only require the signature of the applicant. We will be liaising with MOM on your behalf regarding all the handlings of the documents. Takes less than 1 working day
  • The processing time is around 4 to 6 weeks on the day of submission to MOM.
  • S$3,000 banker’s guarantee is required upon approval of Entrepass.
  • Lastly, We will set up the company for you upon approval of the Entrepass.

The key requirement for the application of an EntrePass is a ten-page comprehensive business plan that outlines the goals and objectives of the proposed business venture plan and includes a strategy to meet the requirements stipulated by the Ministry of Manpower (MOM).

The business venture must demonstrate, within a one-year period, that it will meet the requirements of employing a minimum number of local employees and achieving a specified total business spending.

Note: The application for the Singapore EntrePass must be submitted within six months after the incorporation of a company. Alternatively, you can Apply for EntrePass in advance. Upon approval, the applicant can set up a company as a single Director and Shareholder within 1 month from the date of EP approval.

DEPENDENT PASS

Singapore Incorporation, a licensed MOM employment agency, offers Singapore Dependant’s Pass application services to spouses and children of Employment Pass or S Pass holders to join them in Singapore.

The Dependant’s Pass (DP) entitles the immediate family member of a work visa holder to live in Singapore. To qualify for dependent privileges, the sponsoring work visa holder must earn a minimum monthly salary of SGD 5,000. The status of the Dependant’s Pass is connected to the validity of the sponsor’s Singapore work visa.

Singapore Dependent Pass (DP) is a family member relocation visa issued to spouse and unmarried children (below 21 years) of foreign employees holding a work pass (i.e. an Employment Pass or EntrePass). A separate DP application must be filed for each eligible family member.

A Dependent Pass holder’s status in Singapore is tied to the status of the work pass holder. As long as the work pass holder is gainfully employed in Singapore, the DP holder is eligible to live in the country as well as leave and enter Singapore freely without having to apply for a Singapore visa every time.

Dependent Pass Application:

Please provide:

  • Spouse – Marriage Certificate & Passport, education certificates and last drawn salary details (payslip)
  • Child – Birth Certificate & Passport
  • If your child is going to study in Singapore, you can approach the school directly for enrollment and the school will apply for a student pass for your child and no Dependent pass is required for.

Any non-English document will require an official english translation.

Letter of Consent

We offer Singapore Letter of Consent application services to render further assistance to employers intending to apply LOC for eligible Dependant’s Pass holders, or an LTVP or LTVP+ holders married to a Singaporean or permanent resident.

The Letter of Consent (LOC) is for eligible LTVP/LTVP+ holders married to a Singaporean or permanent resident, and Dependant’s Pass holders who want to work in Singapore. The employer or appointed employment agent can submit your Letter of Consent application. You can only begin working after the employer has received the LOC.

A LOC allows a Dependant’s Pass holder to work in Singapore. To be eligible, the applicant must:

  • be a Dependant of an Employment Pass holder
  • secure a job offer with a Singapore employer
  • have a Dependant’s Pass that is valid for at least three months.

The processing time is usually 1 week as we will submit the LOC application online. For Manual submissions, it takes approximately 4 – 6 weeks to process.

The LOC expires at the same time as your Dependant Pass; therefore you should renew the LOC whenever your DP is renewed.
